The High Court of Cassation and Justice, sitting in the Plenary for Recourse in the Interest of Law, admitted the appeal filed by the Board of Directors of the Suceava Court of Appeal, thereby establishing a mandatory binding interpretation. The dispute concerned the temporal scope and applicability of emergency financial support measures under Government Emergency Ordinance No. 43/2020 (as amended by Law No. 82/2020), specifically whether the provisions of Article 7(5) as modified by Law No. 166/2021 could be applied to civil or commercial cases pending before the courts at the time the new law entered into force. Relying on the principle of legal stability and procedural fairness inherent in the Civil Procedure Code, the Court ruled that the modified provisions of Article 7(5) of OUG No. 43/2020 are not applicable to requests that were already under judicial consideration on the date Law No. 166/2021 took effect, clarifying the non-retroactive nature of the amendment for pending litigation.
