The High Court of Cassation and Justice admitted the appeal in the interest of law filed by the Public Prosecutor, establishing a binding interpretation that determines the competent court for criminal cases against judges and prosecutors based on their effective workplace rather than their superior professional grade. The dispute concerned the procedural competence to try criminal offenses allegedly committed by magistrates who hold a professional rank higher than that of the specific court or prosecutor's office where they are actually serving, which had led to inconsistent jurisdictional determinations. Relying on Articles 38(1)(c) and 40(1) of the Code of Criminal Procedure, the Court ruled that jurisdiction is strictly tied to the location of the magistrate's effective activity, effectively stripping higher-ranked magistrates of the automatic benefit of being tried by instances corresponding to their elevated professional titles, thereby standardizing procedural jurisdiction across the judiciary.
