The High Court of Cassation and Justice dismissed as inadmissible the referral by the Bucharest Court of Appeal, thereby declining to issue a preliminary ruling and leaving the lower court’s procedural posture unchanged. The dispute concerned the interpretation of the aggravated form of the offense of active corruption (bribery) under Articles 6 and 7(2) of Law No. 78/2000 (pre-2014 version), specifically whether the aggravating element requires that the bribe be given in direct connection with the recipient’s control functions or merely that the recipient holds such functions regardless of the direct link. The decision rests on the procedural inadmissibility of the referral under Article 477 of the Code of Criminal Procedure, failing to provide a substantive interpretation of the statutory provisions regarding the nexus between the bribe and the official’s control attributes.
