The High Court of Cassation and Justice (5-judge panel) suspended the appeal proceedings due to the absence of both parties at the hearing, ordering the suspension of the case under Article 411(1)(2) of the Civil Procedure Code; no substantive ruling was made, so the appealed decision (a prior administrative and fiscal chamber ruling) remains in force. The dispute involved a procedural challenge—an appeal against a prior decision—where neither party appeared despite proper citation and did not request a judgment in absentia. The legal basis was the mandatory suspension rule (Article 411(1)(2) C. proc. civ.) triggered when all legally cited parties fail to appear at the hearing; the order is final.
