The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling on a question of law submitted by an appellate court, leaving the lower instance proceedings to continue without a unified legal interpretation. The dispute concerned whether a claim seeking the judicial declaration that the right to enforce an executive title has become time-barred constitutes a common-law claim subject to value-based jurisdiction under Article 94(1)(k) of the Code of Civil Procedure or a special execution matter governed by specific procedural rules under Articles 125 and 651(3)-(4). The decisive legal basis was the procedural requirement under Article 521(3) of the Code of Civil Procedure, which mandates that such references be obligatory; because this condition was not met, the court found the submission inadmissible and declined to interpret the classification of prescription claims in enforcement contexts.
