The High Court of Cassation and Justice, sitting as the panel for resolving legal issues, rejected the preliminary reference for interpretation filed by the Civil Section, thereby leaving the referring court to decide the case without a unifying supreme court ruling. The dispute concerned whether the harm (prejudice) resulting from the commission of the criminal offense of organizing or exploiting illegal gambling games, as defined by the Emergency Governmental Ordinance No. 77/2009, is legally presumed under Article 13(1), Article 14(2)(b)(i), and Article 15(6)(a) of the same ordinance when applying Article 1385(1) and (3) of the Civil Code. By dismissing the reference as inadmissible, the court ordered that no uniform interpretation of the civil liability provisions related to gambling offenses be established at the national level, leaving the application of the presumption of harm to the discretion of the courts of appeal based on the specific facts of the individual case.
