Admissibility of reference regarding concurrence of offenses and post-execution recidivism during aggregate sentence calculation
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ) dismissed as inadmissible a reference for the resolution of a question of law submitted by the Timișoara Court of Appeal. The dispute concerned the procedural and substantive mechanics for determining the final aggregate sentence in complex criminal cases where an unjudged offense (A) is in concurrence with both the first term (B) and second term (C) of a post-execution recidivism structure, specifically addressing whether the rules for concurrence of offenses should be applied before or after the application of recidivism rules, and whether the legal classification of the recidivistic offense (C) could be modified upon the adjudication of offense (A). The lower court sought clarification on whether the recidivism nature retained at offense (C) remains binding as a matter of res judicata or if the trial court adjudicating offense (A) has the authority to modify the legal characterization and penalty of offense (C) during the calculation of the resultant sentence for offenses A, B, and C. The ICCJ found the referral inadmissible under Article 477 paragraph (3) of the Code of Criminal Procedure, which mandates that resolutions of questions of law by the Complete Court for the Resolution of Questions of Law are binding from the date of publication in the Official Gazette.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE
COMPLETUL PENTRU DEZLEGAREA UNOR CHESTIUNI DE DREPT ÎN MATERIE PENALĂ
Minuta deciziei nr.68 Dosar nr. 1422/1/2022
Ședința din data de 25 octombrie 2022
ÎN NUMELE LEGII
D E C I D E:
