The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal, meaning no preliminary ruling was issued on the merits. The dispute concerned whether a political party possesses standing to bring an administrative action to annul an urbanism act issued by a local public authority. The referral sought to resolve a legal question regarding the interpretation of the party's procedural capacity to act as a plaintiff. The decisive legal basis involved the combined interpretation of the provisions on the scope of administrative jurisdiction and standing (Article 2(1)(a) and (p) of Law No. 554/2004), the status and definitions in the Law on Political Parties (No. 14/2003), and the specific environmental protection conditions under Emergency Government Ordinance No. 195/2005.
