The High Court of Cassation and Justice dismissed as inadmissible the reference to decide a legal issue raised by the Suceava Court of Appeal, thereby leaving the lower court to resolve the matter without a binding preliminary interpretation from the apex court. The dispute concerned whether the statute of limitations for a civil liability insurance company’s recovery action against its own insured party is two years, as per the specific insurance code provision, or three years, as per general civil code rules for delictual or contractual claims. The decisive legal basis involved the interpretation of Article 58(b) of Law No. 136/1995 regarding insurance and reinsurance, in tension with Articles 2.517, 2.519(1), and 2.528(1) of the Civil Code governing the prescriptive periods for actions based on insurance relationships versus delictual responsibility, with the court applying Article 521(3) of the Code of Civil Procedure to reject the procedural request.
