The High Court of Cassation and Justice rejected as inadmissible a reference for a preliminary ruling submitted by the Craiova Court of Appeal, thereby upholding the admissibility standards under Article 521(3) of the Code of Civil Procedure. The dispute concerned the interpretation of salary legislation for public defense, public order, and national security personnel, specifically whether the "similar function" corresponding to the rank of colonel encompasses both leadership and execution roles, as defined in Article 4 and points 1, 7, and 11-16 of Note 1 to Annex No. 1 of Law No. 138/1999. The court’s decision resolved the procedural challenge by determining that the question of law was not eligible for binding interpretation, leaving the original administrative and fiscal dispute to be resolved by the lower court without a uniform legal interpretation from the supreme court.
