The High Court of Cassation and Justice dismissed the referral from the Court of Appeal Suceava as inadmissible, thereby denying the requested binding interpretation on whether specific wage surcharges for particularly dangerous conditions are excluded for physicians working under part-time employment contracts within the framework of public salary regulations. The dispute centered on the interpretation of the Framework Law No. 153/2017 concerning the salary of public-funded personnel, specifically the interplay between the general provisions on additional salary components and the specific caps defined in Annex II. The court’s decision leaves the lower court without a definitive legal answer on the admissibility of such surcharges for part-time medical shifts, but the dismissal was procedural in nature, based on the inadmissibility of the request under Civil Procedure Code provisions regarding preliminary questions of law.
