Inapplicability of agricultural land preemption right to alienation of possession under Law No. 17/2014 and Cadastre Law No. 7/1996
Legislator summary
AI generatedThe High Court of Cassation and Justice issued a binding preliminary ruling admitting the referral from the Alba County Court and holding that the right of preemption under Article 4(1) of Law No. 17/2014 does not apply to agreements concerning the alienation of possession of extravilan agricultural land. This decision arose from a procedural dispute regarding the interpretation of sales restrictions for agricultural lands, where the court clarified the scope of preemption rights in transactions involving possession rather than full ownership. The decisive legal basis rests on the combined interpretation of Article 4(1) of Law No. 17/2014 and Article 13(5) of the Cadastre and Real Estate Publicity Law No. 7/1996, establishing that the preemption right is not a mandatory condition for concluding such possession-alienation contracts.
