The High Court of Cassation and Justice (ICCJ), as the Full Bench for Legal Questions, issued a mandatory binding interpretation (Decision No. 57/2022) resolving a conflict raised by the Bucharest Court of Appeal, thereby establishing that in judicial challenges against real estate compensation decisions, the applicable valuation grid for notary public fees must be the one in force in the year prior to the issuance of the contested decision by the National Commission for Real Estate Compensation. The dispute concerned the procedural framework for verifying judicial challenges to decisions under the reprivatization regime, specifically addressing which notary fee schedule serves as the basis for calculating the compensation amount. The decisive legal basis was the interpretation of Article 21(6) of Law No. 165/2013, as amended by Law No. 193/2021 and OUG No. 72/2020, which governs the restitution of properties abusively acquired during the communist regime; the court mandated the use of the pre-decision year's grid, creating a uniform standard for all lower courts handling similar cases.

DECIDE:

521 alin. (3) din Codul de procedură civilă.
