The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Bucharest Court of Appeal, leaving no binding interpretation on the legal question posed. The dispute concerned the interpretation of specific fiscal-budgetary and public-sector salary legislation, specifically whether the combined application of Article 7(2) of Emergency Government Ordinance no. 90/2017 (as amended) and Article 38(3)(a) of Framework Law no. 153/2017 could legally result in a diminution of the net income of individuals subject to these regulations. The court did not resolve the substantive conflict regarding the protection of net public-sector salaries, instead rejecting the procedural request from the lower court to resolve the chestiune de drept, based on the mandatory provisions of Article 521(3) of the Civil Procedure Code.
