The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference question submitted by the Galați County Court, effectively leaving the lower court’s procedural posture unchanged without resolving the substantive legal conflict. The dispute concerned whether prison days served under the transitional regime of Law No. 169/2017, which had already been credited in a previous judicial decision for conditional release, remained valid and deductable from the total punishment resulting from the merger of multiple sentences following the Constitutional Court’s Decision No. 242/2021 declaring certain provisions of that Law unconstitutional. The High Court did not address the merits of whether such days continue to reduce the sentence pursuant to Articles 40 and 38 of the Penal Code, citing instead procedural inadmissibility under Article 477(3) of the Code of Criminal Procedure.
