The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling submitted by the Craiova Court of Appeal, thereby leaving the lower court to resolve the specific case without a definitive interpretative decision from the Supreme Court. The dispute concerned pension litigation under Law No. 263/2010, specifically whether the rules governing the correction of incomplete or incorrect employment group records (Art. 158(31)) apply when proof of service is provided via the work booklet, and whether verifying such errors entails a judicial review of the legal classification of the activity into Group I or II work (Art. 158(6) and (7)). The decision was based on the procedural requirements for admissibility of referrals to the Complete for Clarifying Legal Issues, resulting in the rejection of the request to clarify the interplay between these provisions of the public pension system law.
