Inadmissibility of cassation against intermediate appellate decision annulling judgment and evocating merits
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeal in cassation as inadmissible, leaving the intermediate appellate decision of December 16, 2003, which annulled the first-instance judgment and retained the case for retrial, in force. The dispute concerned the procedural admissibility of a cassation appeal filed directly against this intermediate ruling, specifically challenging the appellate court’s order to cancel the lower court’s sentence and evocare the merits for a definitive judgment. The court held that an appeal in cassation is not admissible against intermediate decisions; pursuant to Article 299(1) of the Civil Procedure Code, only definitive decisions rendering the final judgment are subject to cassation, whereas the decision under review was merely an intermediate step under Article 297(1), making it reviewable only together with the subsequent definitive decision.

Or, conform art. 297 alin. (1) C. proc. civ.
