The High Court of Cassation and Justice decliner of jurisdiction to the Târgu Mureş Court of Appeal, which was identified as the competent instance to adjudicate the transfer of case no. x/2018 from the Topliţa Court, leaving no final determination on the merits of the underlying civil dispute. The proceeding involved a request by a limited liability company for the transfer of a case based on legitimate suspicion (partiality), but the Supreme Court found itself materially incompetent under Article 142(1) of the Civil Procedure Code, which vests authority over transfer requests from lower courts within a specific judicial district in the corresponding Court of Appeal. Applying Article 132 of the Civil Procedure Code, the court issued a non-appealable decision to refer the matter to the proper appellate instance for resolution.
