The High Court of Cassation and Justice rejected as inadmissible the referral of a legal question by the Bucharest Civil Court, thereby denying the requesting court's request for a preliminary decision and leaving the lower instance to proceed without an overarching binding interpretation from this Supreme Court. The dispute concerned whether, in applying the Court of Justice of the European Union's ruling in Cases C-359/14 and C-475/14, the analysis of Romanian law regarding the subrogation rights of a compulsory motor insurance (RCA) insurer of a towing vehicle against the insurer of a semi-trailer must be limited to general civil code provisions or must also incorporate specific regulatory norms issued by the Financial Supervision Authority concerning recourse. The decisive legal basis was the procedural inapplicability found under Article 521(3) of the Code of Civil Procedure, which governed the admissibility of the preliminary ruling request.
