The High Court of Cassation and Justice rejected as inadmissible the referral for the resolution of a legal question submitted by the Court of Appeal of Iași, meaning no ruling on the substantive issue was issued and the referring court retained jurisdiction. The dispute concerned the procedural effect of the removal of a document from the evidence file due to the failure of the submitting party to appear for its verification, specifically whether the resulting legal presumption is irrevocable in appeal or can be rebutted by counter-proof and re-examination of evidence under the devolutive nature of the appeal. The Court’s decision was based on the procedural requirements of Article 521(3) of the Code of Civil Procedure, which governed the admissibility of the request for a preliminary decision under Articles 306(2) and 328(2) of the Code of Civil Procedure, rendered in light of the Supreme Court’s earlier ruling on the legal regime of such presumptions.
