The Romanian High Court of Cassation and Justice rejected as inadmissible a referral from the Alba Iulia Court of Appeal seeking a preliminary ruling on whether the 6-month (during criminal investigation) and 1-year (during trial) periods for periodic verification of the continued grounds for a preventive seizure measure under Article 250² of the Criminal Procedure Code are procedural deadlines (whose expiry would trigger the measure's lapse) or mere administrative review intervals. The court thereby declined to answer the legal question, leaving the prior proceedings in force, and held the referral inadmissible because the requesting court failed to demonstrate that the issue had actually arisen in the pending case and that its resolution was necessary for the disposition of that case, as required by Article 475 of the Criminal Procedure Code; the decision is binding from publication in the Official Gazette under Article 477(3) of the same code.
