The High Court of Cassation and Justice, sitting as the Special Chamber for Resolving Questions of Law, dismissed as inadmissible the preliminary reference (sedință publică) submitted by the Cluj Court of Appeal. The dispute concerned the interpretation of Law No. 153/2017 regarding public sector salary increases, specifically whether the statutory provision referencing salary increases "regulated by legal acts" applies exclusively to increases established by normative acts (laws, emergency orders) or administrative acts, or if it also encompasses salary increases recognized through individual judicial decisions. The court did not rule on the merits of the legal question but rejected the request for a prior ruling, citing procedural inadmissibility under Article 521(3) of the Code of Civil Procedure.
