The High Court of Cassation and Justice confirmed the dismissal of the appellant's appeal for lack of legal merit, leaving the first-instance ruling in force. The dispute concerned the procedural outcome of an administrative fiscal case where the Court of Appeal had suspended the proceedings due to the absence of the parties, a decision challenged by the plaintiff on appeal. The appellate court declared the appeal null and void, invoking ex officio the exception of nullity, because the appellant failed to include the specific grounds of illegality and their development required by Article 3021(1)(c) of the Code of Civil Procedure in the declaration of appeal. The court held that the appeal was null under Article 306(1) of the Code of Civil Procedure due to the lack of motivation within the legal term, noting that no grounds of public order existed for the court to raise ex officio, and consequently ordered the annulment of the appeal.

Şedinţa publică din data de 26 martie 2021

Asupra recursului de faţă;

242 pct.
