Eligibility for pandemic social protection measures denied to lawyers without 2019 revenue due to late qualification
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the referral from the Timișoara Court of Appeal and established that a legal professional who acquired their status in 2020, after the start of the reference year but before the state of emergency, does not meet the eligibility criteria for specific social protection measures. The dispute concerned the interpretation of conditions for accessing financial support during the SARS-CoV-2 pandemic, specifically whether an individual with no recorded income in 2019 due to late qualification could satisfy the requirement of a revenue drop. Relying on Article XV(1) and (11) of Emergency Government Ordinance No. 30/2020, the court ruled that the statutory condition of "realizing receipts at least 25% lower than the monthly average for 2019" explicitly excludes cases where no revenues were realized in 2019, thereby denying the applicant's claim for benefits.
