The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling submitted by the Maramureș Court of Appeal, leaving the lower court to resolve the matter without binding guidance from the supreme court. The dispute concerned whether a civil action for the reconstitution of ownership rights over land is admissible when the administrative procedure for establishing private property rights has not been finalized and no decision by the county commission exists. The legal issue centered on the interpretation and application of Articles 51–53 of the Land Fund Law (Law No. 18/1991) in light of the reasoning in Constitutional Court Decisions No. 44/2017 and No. 139/2018, specifically regarding the prerequisites for judicial intervention in land restitution cases.
