The High Court of Cassation and Justice rejected the referral from the Bucharest Court of Appeal as inadmissible, thereby leaving the lower court's pending civil case unresolved at this level. The dispute concerned a civil action for moral damages against an insurance company and the Romanian Association for Auto Insurance, where plaintiffs sought joint and several liability for payment, specifically challenging whether they could elect between the statutory penalty of 0.2% per day of delay under the Emergency Ordinance on compulsory civil liability insurance and the legal penal interest under the Government Ordinance on legal interest, as amended by the Civil Code. The court's decision hinges on the procedural admissibility requirements under Article 521(3) of the Code of Civil Procedure for preliminary referrals on issues of law, determining that the submission did not meet the necessary criteria for the supreme court to intervene.
