The High Court of Cassation and Justice dismissed as inadmissible the preliminary ruling request filed by the Bucharest Court of Appeal, leaving the lower court's procedural standing unaffected as no substantive legal interpretation was mandated. The dispute concerned a request for clarification on whether a lower appellate court was constituted in violation of the law, specifically questioning if the composition of the appellate panel complied with statutory requirements in relation to the specific appeal route or the solution pronounced in the initial penal decision. The decisive legal basis for the dismissal was the procedural inadmissibility of the referral, rendered under Article 477(3) of the Code of Criminal Procedure, which governs the mandatory application of such decisions only upon publication in the Official Gazette after they have been validly issued.
