The Supreme Court of Romania dismissed the reference for a preliminary ruling as inadmissible, meaning no substantive decision on the legal question was issued and the referring appellate court must proceed independently. The dispute arose from a request by the Bucharest Court of Appeal, Section VII for Labor and Social Security Conflicts, seeking clarification on whether the statutory wage increase under Article 7 of Annex I, Chapter I, Letter B, and Article 38 of Law No. 153/2017 applies to the basic salary in payment starting July 1, 2017. The Supreme Court’s decision was based solely on procedural grounds, rejecting the admissibility of the referral without addressing the interpretation of the public sector salary legislation, thereby leaving the specific legal interpretation to the lower court in accordance with the mandatory nature of its decision under Article 521(3) of the Code of Civil Procedure.
