Competence for salary enforcement claims against Romanian Gendarmerie institutions: labor dispute specialization over administrative jurisdiction
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the recusal in the interest of the law filed by the Presiding Body of the Court of Appeal of Constanța, establishing a binding interpretative rule for all courts. The dispute concerned the material jurisdictional conflict regarding which court had competence to hear first-instance claims by military personnel of the Romanian Gendarmerie for the enforcement of salary rights. The court determined that the specialized sections or panels for labor law disputes within the county courts (Tribunals) hold exclusive material jurisdiction over such cases. This ruling is grounded in the interpretation of Article 382 lit. h) and Article 536 of Emergency Government Ordinance No. 57/2019 (Administrative Code), Article 1 lit. p) of Law No. 62/2011 on Social Dialogue, and Article 23(1) of Law No. 550/2004 on the Organization and Functioning of the Romanian Gendarmerie, with the decision possessing mandatory force under Article 517(4) of the Code of Civil Procedure.
