The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal seeking a preliminary ruling on whether Article 63(12), first sentence, of Decree No. 240/2020 (extending the state of emergency in Romania) applies to limitation periods (perimare) already running when the state of emergency was declared. The referral arose in a labor and social insurance case (docket no. 30113/3/2008) and concerned the interpretation of that decree provision. The court held the referral inadmissible under Article 521(3) of the Civil Procedure Code, meaning the requested interpretative ruling was not issued; the decision is binding as to the admissibility determination, and no substantive ruling on the disputed legal question was made.
