The High Court of Cassation and Justice admitted its own exception of material incompetence and declined jurisdiction over the ancillary motion to stay proceedings in case no. x/2019 of the Olt Tribunal (civil, administrative and fiscal section) to the Craiova Court of Appeal; the transfer motion based on legitimate suspicion was therefore to be decided there, with the stay request falling to the panel seized of that transfer. The dispute concerned a request by a company, through its special administrator, to transfer venue and suspend the underlying case pending the transfer ruling. Legally, under Articles 142(1) and 143(1) of the new Civil Procedure Code, a transfer request on grounds of legitimate suspicion lies with the court of appeal if the court from which transfer is sought is a tribunal within its circuit, and the stay motion is within that same panel's competence; because the originating court was the Olt Tribunal, the Craiova Court of Appeal was the proper forum. No further appeal was permitted.
