AI generated

The High Court of Cassation and Justice dismissed the referral for a preliminary ruling as inadmissible, meaning no uniform interpretation was established and the lower court's judgment remains subject to its original procedural fate. The case involved a civil tax dispute concerning the correct application of the Romanian Fiscal Code, specifically challenging whether income tax rates on pension income differences for retroactive periods should be calculated on a monthly basis or withheld in full based on the date of payment. The decision was grounded in procedural admissibility standards rather than a merits review of the fiscal provisions in Article 101(6) and (8) of the Fiscal Code, and the ruling is binding under Article 521(3) of the Code of Civil Procedure.
