The High Court of Cassation and Justice, through its United Sections, granted the appeal filed in the interest of the law by the Presiding Council of the Alba Iulia Court of Appeal, establishing a binding mandatory interpretation for all courts. The dispute concerned the statutory calculation of salary supplements for auxiliary staff within judicial courts and prosecutors' offices, specifically addressing whether such payments are exempt from general wage caps. The Court determined that the sum of these specific bonuses must not exceed the maximum limits established for the credit officer responsible for salary disbursement. This ruling provides a uniform legal interpretation of Article 38(3)(a) and 38(6) of Framework Law No. 153/2017 regarding public sector salarization, read in conjunction with Articles 4 and 5 of Section I, Chapter VIII of Annex V, and Article 25 of the same Act, confirming that auxiliary staff remain subject to the aggregate salary ceiling provisions.
