Recusal challenge does not halt proceedings, only defers judgment; unitary interpretation established.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the interest of the law and established a mandatory, unitary interpretation of Article 49(2) of the Romanian Code of Civil Procedure: filing a challenge for recusal (before or after the start of any debates) does not prevent the court from continuing procedural acts or the merits hearing, but only suspends the rendering of the judgment until the recusal request is resolved. The ruling settles a divergent practice concerning whether recusal proceedings halt ongoing litigation, clarifying that only the final judgment is deferred.

517 alin. (4) din Codul de procedură civilă.
