Cessation of effect of amended restitution compensation statute following constitutional ruling on pending pre-amendment claims
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the referral from the Court of Appeal and ruled that Article 21(6) of Law No. 165/2013, as amended by Law No. 219/2020, ceased to have legal effect and no longer serves as a valid legal basis for pending civil cases concerning pre-amendment compensation decisions that were not finally resolved by the date of the Constitutional Court’s publication; consequently, the statutory provisions invoked by the lower court for such claims are deemed inoperative for these specific proceedings. The dispute centered on the interpretive and applicability of civil restitution and compensation laws regarding properties abductively taken during the communist regime, specifically whether the 2020 legislative amendments could retroactively govern existing, unresolved compensation judgments. The decisive legal basis is the constitutional ruling (Constitutional Court Decision No. 189/2021), which established that the challenged statutory modifications lost their effect, thereby mandating that courts exclude the amended Article 21(6) from cases with compensation decisions issued prior to the legislative changes but still pending at the time of the constitutional decision's publication.
