The High Court of Cassation and Justice dismissed as inadmissible the reference question submitted by the Bucharest Court of Appeal regarding the interpretation of Article 50 of Government Ordinance No. 39/2005 on cinematography. The dispute concerned the admissibility of administrative appeals and the jurisdiction of the complaint-solving commission within the Ministry of Culture to re-evaluate film scripts and project assessments (scenario, director, producer) following a selection competition organized by the National Film Centre. The court did not provide a preliminary ruling on the substantive legal interpretation, but instead rejected the request, thereby leaving the lower court to resolve the case without the requested clarification on whether procedural non-compliance allows for a de novo review of artistic and professional criteria under the mentioned legislative provision.
