The High Court of Cassation and Justice, acting through its General Assembly for the Resolution of Legal Issues, admitted the referral from the Bucharest Court of Appeal and established a binding interpretation of the law. The dispute concerned whether a letter of guarantee issued by a credit institution constitutes an enforceable title, with the court ruling that such a document qualifies as an enforceable title only if it was issued to guarantee a credit contract. This decision, which is mandatory for all courts pursuant to Article 519(3) of the Code of Civil Procedure, relies on the combined application of Articles 2279 and 2321 of the Civil Code and Article 120 of Emergency Government Ordinance No. 99/2006.
