The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling on a question of law submitted by the Harghita District Court. The dispute concerned the continued applicability of the prior version of Article 55(1) of the Family Code (Law No. 4/1953), which governed the legal status of children born to unmarried parents, in light of Article 8 of the European Convention on Human Rights as interpreted by the Court of Strasbourg jurisprudence. The Court determined that the referral was procedurally inadmissible, thereby leaving the lower court to address the substantive civil matter without a binding interpretation from the supreme bench; no substantive ruling on the conflict between domestic family law and ECHR standards was issued in this specific decision.
