The High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling submitted by the Braila Court of Appeal. The dispute concerned the interpretation of Article 906(4) of the Code of Civil Procedure, specifically whether a creditor retains the right to request the fixing of a final sum for penalties when the debtor performs the obligation within less than three months of the communication of the court ruling issued under Article 906(2) or (3). By rejecting the request, the Court of Appeal’s pending civil procedure continues without a binding preliminary interpretation from the High Court on this procedural matter. The decision rests on the procedural admissibility requirements for submitting questions of law to the High Court under Article 521(3) of the Code of Civil Procedure.
