The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal, leaving the lower court's procedural posture to resolve the matter without establishing a binding interpretation. The dispute concerned whether the Romanian state was obligated to pay specific allowances for overseas missions, including currency-based per diems and family linkage benefits, regardless of whether international organizations hosting the mission provided equivalent financial rights under different denominations. The decisive legal basis involved the interpretation and application of Article 1(1) and Article 3 of Government Decision No. 1,086/2004 regarding specific allowances and mission benefits, alongside the procedural framework of Article 521(3) of the Civil Procedure Code governing the competence of the General Court for resolving questions of law.
