The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Board of Directors of the Court of Appeal of Constanța, establishing a mandatory binding interpretation that applies uniformly to all courts. The dispute concerned the scope of the exception of illegality in administrative litigation, specifically whether this procedural defense could be raised against individual administrative acts issued prior to the enactment of the relevant legislation. Deciding the issue, the Court held that under Article 4, paragraph (1) of Law No. 554/2004 on administrative litigation, the exception of illegality may indeed be invoked with respect to individual administrative acts adopted or issued before the entry into force of that Law.
