Admissibility of referral on pension debt waiver scope following abrogation of methodological norms
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the Full Bench for resolving questions of law, dismissed as inadmissible the referral submitted by the Oradea Court of Appeal. The dispute concerned the interpretation of Article 1(1) of Law No. 125/2014 regarding the waiver of debts arising from pensions, specifically whether the 2019 abrogation of certain methodological norms—previously annulled by a final appellate decision—extended the waiver to debts issued under Article 179 of Law No. 263/2010 for periods subsequent to October 1, 2014. The court rejected the attempt to establish a unified legal interpretation, applying Article 521(3) of the Code of Civil Procedure to find the question inadmissible, thereby leaving the lower court’s pending proceedings to be resolved without a binding preliminary ruling.
