The Supreme Court (High Court of Cassation and Justice) dismissed as inadmissible the referral of a question of law submitted by the Maramureș County Court, leaving the lower court's procedural handling of the case to proceed without a preliminary ruling from the Supreme Court. The dispute concerned the temporal scope of application of the 2018 amendment to the Code of Civil Procedure regarding claims for damages, specifically whether the new provisions applied only to enforcement proceedings initiated after the law's entry into force or also to damages claims filed after that date for enforcement actions initiated previously. The decisive legal basis was Article 521(3) of the Code of Civil Procedure, under which the Supreme Court rejected the referral for failing to meet the admissibility criteria for resolving questions of law.
