Composition of judicial panels for resolving conflicts of competence in appellate and cassation proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Administrative Board of the Court of Appeal of Constanța, issuing a binding interpretation that resolves how court panels are composed for jurisdictional conflicts. The dispute concerned the correct composition of the judicial panel (*completul de judecată*) required to adjudicate conflicts of competence arising during appellate or cassation proceedings, specifically addressing whether the panel should reflect the composition required for the substantive case at that procedural stage or a fixed number. The Court established that, pursuant to Articles 135 and 136 of the Code of Civil Procedure read in conjunction with Article 54 of Law No. 304/2004, the panel must have the composition prescribed for the procedural stage where the conflict arose, with specific exceptions mandating a three-judge panel for conflicts within the exclusive competence of the High Court or a five-judge panel for cases under Article 136(3) of the Code of Civil Procedure.
