The High Court of Cassation and Justice, acting as the full bench for resolving issues of law, dismissed as inadmissible the reference for preliminary interpretation submitted by the Oradea Court of Appeal, thereby leaving the referring court to resolve the matter without a binding directive from the Supreme Court. The dispute concerned the interpretation of Article 325 of the National Education Law regarding the applicability of rules on serious breaches of scientific research and university activity to misconduct committed prior to the statute's entry into force, a question raised during civil proceedings concerning academic conduct. The decisive procedural basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which renders such references obligatory only under specific conditions not met by the present inadmissible submission.
