The Supreme Court of Romania’s Unified Panel dismissed as inadmissible a preliminary reference submitted by the Bucharest-based appellate court, leaving the lower court to resolve the underlying civil dispute without higher judicial guidance on the specific legal question. The case arose from a disagreement regarding the proper legal framework for classifying employed personnel of voluntary emergency services into special working conditions for the purpose of calculating seniority or benefits. The core legal issue concerned whether Article 39(1) of Law No. 307/2006 on fire protection mandates the application of Government Decision No. 1,025/2003 (general methodology for special working conditions) or, instead, the specialized norms applicable to active military and police cadres, namely Government Decision No. 1,294/2001 and the Ministry of Interior Order No. 283/2002. The Court’s ruling, pursuant to Article 521(3) of the Code of Civil Procedure, determines that the reference was procedurally defective, thereby rejecting the attempt to standardize the interpretation of these conflicting regulatory instruments at the supreme level.
