Forest personnel risk allowance established as 25% of base salary via binding interpretation
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting as the panel for appeals in the interest of law, admitted the appeal filed by the appellate court's leadership and issued a binding interpretation that forest personnel are entitled to a 25% risk allowance on their base salary. This decision resolved a dispute regarding the application of Article 120(5) of Forest Law No. 46/2008, specifically addressing the legal vacuum created by the absence of the normative acts, regulations, and best practice guides required under Article 115(1) of the same statute. The court established that in the lack of such implementing norms, the statutory 25% risk bonus remains applicable, thereby clarifying the rights of forestry employees and providing a mandatory precedent for uniform judicial application across all jurisdictions.
