Daily duty assignment versus functional authorization status for special public officials
Legislator summary
AI generatedThe High Court of Cassation and Justice, in its capacity to rule on recourse in the interest of the law, admitted the appeal filed by the board of directors of the Cluj County Court of Appeal, thereby establishing a binding, mandatory interpretation of the law. The dispute concerned whether the designation of an officer to perform additional specific duties of a management position via a "decision of the day" constitutes an authorization for a function under the relevant statute. The Court held that such a daily designation does not constitute a functional authorization equivalent to those provided for in Article 55(3) of Law No. 293/2004 regarding the status of public officials with special status in the National Prison Administration. This ruling clarifies that ad-hoc assignments of duties do not trigger the legal effects or entitlements associated with formally authorized managerial roles.
