The High Court of Cassation and Justice (ICCJ) resolved a preliminary question of law in favor of the strict statutory interpretation, establishing that a creditor can no longer file a request for compensation for non-performance in kind after the execution court has ruled on a penalty claim or after the statute of limitations for enforced execution has expired. The dispute concerned the procedural admissibility of claims for damages regarding the personal performance of an obligation under administrative and fiscal litigation, specifically challenging whether such compensation could be sought indefinitely. The decisive legal basis is Article 24(4) of the Administrative Litigation Law No. 554/2004, as amended by Law No. 138/2014, interpreted to mean that the specific provision for establishing compensation is time-barred or preempted by the execution court's decision on penalties or the passage of the limitation period.
