The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference submitted by the Cluj Court of Appeal, leaving the lower instance proceedings unresolved at this stage. The dispute centered on whether the publication of a Government Order amending regulations on the rights of Romanian personnel on temporary foreign missions in the Official Gazette established the objective moment when a claimant should have known of their monetary rights, which were governed by a separate, unpublished Government Order on specific allowances and per diems under civil law. The decisive legal basis for the dismissal was the procedural standard for admissibility of questions of law under Article 521(3) of the Civil Procedure Code, rather than a substantive determination on the interpretation of Civil Code Article 2,523 regarding prescription or knowledge of rights.
